Terms of Sale.

Who you are buying from
You are buying from Wine Dark, LLC, doing business as The Spray Bottle Project, 680 North Lake Shore Drive, Suite 110 - 2682, Chicago, IL 60611. These terms apply to every commission placed through this site.
The offering
DuraSpray™ No. 01, Founder’s Edition, is offered as ten individually numbered units, built to order at $5,000 each. It is a one-time edition. A commission is an order, not a reservation: when your payment clears, a number is assigned to you and work is scheduled. Engraving text is yours to choose, but we may decline text that is offensive, infringing, or that we cannot reproduce. We will contact you first, and you may cancel for a full refund if we cannot agree.
Price and payment
Prices are in US dollars. Sales tax is calculated and collected at checkout where we are required to collect it, and the total is shown before you confirm. Payment is taken in full at commission by ACH bank debit, processed by Stripe. Bank debits take up to four business days to clear, and your commission is confirmed once the debit clears. We do not accept cards for this offering.
Lead time
The current lead time is six months from commission to shipment. Lead times are honest estimates rather than guarantees. If we cannot ship within the lead time quoted when you commissioned, we will tell you promptly and give you a revised expected date. If the revised date is within 30 days of the original, the build continues unless you tell us to cancel, which you may do at any time before it ships, for a full refund. If the revised date is later than that, we continue only with your express consent; if we do not hear from you within 14 days of our notice, we cancel and refund you in full.
Cancellation, refunds, and returns
You may cancel for any reason within 72 hours of placing your commission, no questions asked, for a full refund. We initiate refunds within 5 business days of your request. Because payment is by ACH bank debit, a refund cannot be sent until your debit has cleared, which takes up to 4 business days, and your bank may take several further business days to post it. After 72 hours the commission is final. Each unit is built to your order, carries your number and, on brushed units, your engraving, and cannot be resold, so we do not offer refunds, returns, or exchanges after the cancellation window, with two exceptions: a shipping delay, as set out under Lead time above, and a unit that arrives damaged or defective, which we repair or replace at our cost. Shipping and risk of loss
We ship to addresses in the United States only. Shipping is free and insured, and delivery requires an adult signature. We confirm your shipping address before dispatch. Risk of loss passes to you on delivery. Details are on the Shipping page.
Use and compatibility
This is a working instrument, and what you put through it matters. Our published compatibility guidance sets out which solutions are suitable. Damage caused by solutions we identify as not compatible, by freezing, by heat above 90 degrees Fahrenheit, or by disassembly beyond the documented service steps, is not covered.
The product is not sold, tested, or certified for food contact. Individual components carry their own manufacturers’ registrations; the assembled unit has not been evaluated by the FDA or any other body for use with food or drink, and we make no food-safety claim for it. Any such use is at your own risk.
Warranty, support, and parts
The machined metal parts are covered by a limited lifetime warranty for the original owner, set out in full on the Warranty & Repairs page. A repair kit ships with every unit, and wear parts are available for purchase through support for as long as you own it. We do not offer bench repairs.
Intellectual property
DuraSpray No. 01 and The Spray Bottle Project are marks of Wine Dark, LLC. The design is the subject of a pending patent application. Nothing on this site grants a license to use our marks, drawings, or photography.
Disclaimers
Except for the limited warranty on the Warranty & Repairs page and as stated in these terms and on the Returns & Refunds page, the product is provided without warranties of any kind, whether express or implied, to the fullest extent the law allows. Nothing here limits any right you have that cannot be limited by law.
Limitation of liability
To the fullest extent permitted by law, our total liability arising out of any commission is limited to the amount you paid for it. We are not liable for indirect or consequential losses.
Talk to us first
If something goes wrong, tell us before you do anything else. Write to us through the contact form, describe the problem and what you would like us to do about it, and give us 30 days to put it right. Most problems are solved in a single reply. Neither of us will start a court case about a commission until that 30 days has passed, except to stop something that cannot wait. This step does not limit any right you have under law, including small claims court.
Governing law
These terms are governed by the laws of Illinois, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Cook County, Illinois.
